Terms and Conditions

WaMarketingSoft is a WhatsApp marketing and digital marketing software company based in Dhaka, Bangladesh. We provide marketing tools, automation software and official WhatsApp Business API services to businesses and agencies.

• We are a Meta Tech Provider and an official WhatsApp Business API provider.
• We develop and own our own products, including WaMSoft (WhatsApp API platform), WaBaCRM, WA Sender and LeadWave.
• We also resell genuine licensed tools built by third-party developers. For those products we are the authorised reseller, not the original developer.
• Each product page states clearly whether the product is developed by us or resold by us.

All digital products sold by WaMarketingSoft are genuine — either built in-house or purchased legally from trusted marketplaces and authorised developers.

• You may use the software for your own business and marketing purposes.
• Resale and white-label rights are granted only on plans that state them explicitly, such as our Reseller and Source Rebranding plans.
• Redistributing, re-uploading, or sharing our software, licence keys or installer files for free is strictly prohibited.
• Sharing one licence across multiple businesses or clients without a reseller plan is not permitted.

• Products we develop are licensed to you under the terms shown on the relevant product and pricing page.
• Products we resell remain subject to the licence terms of their original developer.
• Licences are issued per user, per device or per domain as stated on the plan you purchased.
• Reverse engineering, decompiling, cracking, or generating illegal licence keys is strictly prohibited.
• Removing or altering our branding is not permitted unless you hold a white-label or Source Rebranding licence.

Payments are processed through secure and trusted payment gateways. Prices are listed in USD, with the equivalent in BDT and INR shown for convenience at a rate of 1 USD = 100 BDT = 100 INR.

• Orders are placed through our official order form, which lists every payment method we accept.
• Licence keys, download links and activation details are delivered over WhatsApp to the number used at the time of order.
• Delivery is normally completed within a few hours of payment confirmation.
• Subscription plans renew only when you choose to renew them. We do not charge automatically without your confirmation.

• We provide support for installation, activation and usage guidance over WhatsApp.
• For products we develop, we release updates and fixes regularly and announce them on our official WhatsApp channel.
• For products we resell, major updates depend on the original developer and are outside our control.
• Support covers our software itself. It does not cover your server, hosting, domain, third-party plugins, or your own custom code.
• Lifetime updates cannot be guaranteed for any product, including lifetime licences.

Because our products are digital and delivered instantly, refunds are limited. Please read this section before ordering.

• A refund may be issued if the software is defective or does not work as described, and you report the problem within 12 hours of purchase.
• You must give us a reasonable opportunity to fix the problem first. Most issues are resolved the same day over WhatsApp.
• If a refund is not possible, an alternative product of equal value may be offered instead.
• We do not refund for change of mind, accidental purchase, or because you no longer need the product.
• We do not refund where your WhatsApp number was restricted or banned due to how you used the software. See section 8.
• Source code, white-label and Source Rebranding purchases are non-refundable once the files have been delivered.

You are responsible for how you use our software and for complying with the laws of your own country.

• Message only people who have given you consent to contact them.
• Honour opt-out and unsubscribe requests promptly.
• Follow the data protection and electronic marketing laws that apply to you.
• Do not use our software for spam, scams, phishing, fraud, or any illegal activity.
• Do not send content that is abusive, hateful, deceptive, or harmful to others.
• Do not use our software to impersonate another person, business or brand.

We may suspend or terminate your licence without refund if we find your use breaches this section.

WhatsApp, Telegram, email providers and other platforms set their own rules. Those rules change without notice and are entirely outside our control.

• Our official WhatsApp Business API service runs on Meta's approved infrastructure and is the compliant way to send at scale.
• Tools that automate WhatsApp Web — including Chrome extensions and bulk senders — are not the official API. Using them carries a real risk of your number being restricted or banned.
• We provide delay management, warm-up guidance and best practices to reduce that risk, but we cannot eliminate it.
• We are not liable for any number restriction, ban, account loss or business loss resulting from platform enforcement.
• A banned or restricted number is not grounds for a refund.

• Our software is provided on an "as is" basis, without warranty of uninterrupted or error-free operation.
• You are responsible for legal and compliant use according to your country's laws.
• WaMarketingSoft is not responsible for misuse of the software, including spam, illegal activity, or violations of WhatsApp, Meta, Telegram or email provider policies.
• We are not liable for indirect or consequential losses, including lost profit, lost data, lost contacts, or business interruption.
• Where liability cannot be excluded by law, our total liability is limited to the amount you paid us for the product in question.

• The WaMarketingSoft name, logo, website content and our own products — including WaMSoft, WaBaCRM, WA Sender and LeadWave — are our intellectual property.
• For products we resell, all product names, trademarks and copyrights belong to their respective developers, and we claim no ownership of that intellectual property.
• WhatsApp is a registered trademark of Meta Platforms, Inc. Our tools that work with WhatsApp Web are not affiliated with, endorsed or sponsored by WhatsApp LLC or Meta Platforms, Inc.
• You may not copy, republish or resell our website content, branding or product materials without written permission.

We may update these Terms and Conditions from time to time as our products, pricing and the platforms we work with change. The "Last updated" date at the top of this page always shows the current version.

Continuing to use our website or software after an update means you accept the revised terms. We recommend reviewing this page occasionally.
